Terms of Service
vyvyfy is a career & business networking platform with a mix of business & social features. This is a legally binding agreement consisting of the "Terms of Service" that regulate your use of the website www.vyvyfy.com
If you wish to join as a member, use the services and participate in the community, read these "Terms of Service" carefully and indicate your acceptance of the same by signing up as a member. On signing up, you acknowledge that you have read and understood the "Terms of Service" and by joining and using the vyvyfy network (website) you agree to be bound by this agreement ("Terms of Service"). If you do not want to become a member, do not accept the Agreement, do not sign up and do not access and use any of the services on vyvyfy website.

This is a legally binding Agreement for the use of this web site and your membership in the service and can be modified by vyvyfy at any time and without any prior notice, such modifications to be effective upon posting by vyvyfy on the Web site.

Article I - Using the services on the vyvyfy website and your rights
This Article sets out the terms relating to the services available on the website and your rights to use the website and its services.
1. Creating an account on the website
1.1 Create an account on the website by registering your details including a user name and a password. You should ensure that all details regarding your account including login details and password remain confidential at all times and it shall remain your responsibility. Any unauthorized login using your details by any other person should be avoided and is your responsibility for preventing such acts. Its your responsibility to use the website using your own login details and password. You should ensure the safety of your password and should not disclose it or permit it to be used by any other person. 3. Intellectual Property Rights

4.2 You retain all of your ownership rights in your user submissions on www.vyvyfy.com. However, by submitting user submissions to vyvyfy, you hereby grant vyvyfy a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the user submissions in connection with the vyvyfy website and vyvyfy's business, including without limitation for promoting and redistributing part or all of the vyvyfy website and derivative works thereof in any media formats and through any media channels. You also hereby grant each user of vyvyfy.com a non-exclusive license to access your user submissions through the website, and to use, reproduce, distribute, display and perform such user submissions as permitted through the functionality of the Website and under these Terms of Service. The above licenses granted by you terminate within a commercially reasonable time after you remove or delete your user resources from vyvyfy.com. You understand and agree, however, that vyvyfy may retain, but not display, distribute, or perform, server copies of user submissions that have been removed or deleted. The above licenses granted by you are perpetual and irrevocable.
5. Your liability
5.1 You hereby indemnify us and agree to keep us indemnified against any and all claims, damages, losses, liabilities and costs arising from and in connection with your use and abuse of the Website and/or Services or your breach of the Terms and Conditions
6. Payments
6.1 If you subscribe to any services that we offer for a charge, you will pay the applicable fees (including, without limitation, monthly fees for premium accounts) as they become due plus all related taxes and reimburse us for any collection costs and interest for any overdue amounts.
7. General
7.1 In order to use and benefit from the Services, you must provide us with correct and up to date details. You warrant to us that the details you provide on registration are correct. They supersede any previous agreement or understanding in relation to the subject matter hereof. They may only be varied where separately agreed in writing between you and us.

7.7 The interpretation, construction, effect and enforceability of this "Terms of Service" shall be governed by Indian Law, and you and we agree to submit to the non-exclusive jurisdiction of the Indian courts for the determination of disputes.

8. International Use
8.1 Recognizing the global nature of the Internet, you agree to comply with all applicable local rules including but not limited to rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from India or the country in which you reside.
9. Trademarks
9.1 1 vyvyfy, vyvyfy logo and other related graphics, and sub-logos, are the trademarks of vyvyfy and may not be used without permission. Other trademarks, Company Logos, and trade names that may appear on the network are the property of their respective owners.

10. Access
10.1 In certain cases, we may restrict access to some parts of the website, or the entire website, to members who have registered with us.
10.2 We ensure that the website operates at its best at all times, but at the same time we make no warranties as to the availability or accessibility of the website and we reserve the right to alter any part of the website at any time and to suspend or withdraw the website at any time and for any reason. Save as otherwise set out in the "Terms of Service" we shall not be liable for any damages, loss, costs or expenses incurred by you as a result of any lack of availability or accessibility of the Website and any event beyond our reasonable control.

13. Warranties and liabilities

The details and description of the advertisements are supplied by those advertising the position (the "Advertiser"). We are not able to verify the accuracy of the content (including but not limited to any statements and descriptions relating to the position) of advertisements or other information provided to us by Advertisers. Any information in the advertisements or any information included on the Website is followed by you at your own risk and we do not warrant the accuracy of the content in any respect. We cannot be held liable for any use or reliance you make of or put on it.

13.3 We shall not be liable to you for any loss of profits, loss of contracts, loss of revenue, loss of business or goodwill, or any indirect, special or consequential loss or damage incurred by you (whether arising from breach of contract, negligence or otherwise) and whether or not we have been advised of the possibility of the loss.

Article III - Applying for Jobs available through the Job search engine
This Article sets out the terms relating to the Jobs available through the job search engine on vyvyfy.
14.1 The Job search engine is developed for vyvyfy by a third party vendor.

14.2 The jobs contained in vyvyfy's search results, or linked from those results, have been created by people over whom vyvyfy exercises no control. vyvyfy's job search results are indexed in an automated manner and vyvyfy does not screen the jobs. vyvyfy assumes no responsibility for the content of any job listing or website that is either included in vyvyfy's search results or linked to by vyvyfy.com.

Article V - Candidates for jobs
This Article sets out the terms, which apply, to Candidates referred for jobs through the Website.
15.1 If you are not a member of vyvyfy, you will be first asked to register before applying. You can upload your resume through your profile. If you wish to apply for the position, you must send your curriculum vitae to us, via a link below the said opening that we shall then pass on to the Advertiser. The Advertiser will contact you direct if they wish to consider you for the position.

15.2 In case of "sponsored jobs" we become involved in the recruitment process or contact the Advertiser on your behalf. Only once we obtain your consent will we disclose your details to the applicable Advertiser.

15.3 We cannot advise you on issues of employment law and you should consult a suitably qualified lawyer if you have any specific legal questions or problems. Any information contained on the Website is general information only and nothing on the Website can be construed as advice on legal or employment issues.

15.4 We make no warranties or representations in respect of any positions offered by Advertisers, including, but not limited to, the quality of any position.

15.5 Advertisers of positions on the Website will include various businesses from a range of market sectors and could include individual companies and recruitment agencies. Whilst we shall use our best efforts in good faith to check that Advertisers who advertise position on the Website are legitimate businesses, you acknowledge that by providing your details to an Advertiser we are simply introducing you to the Advertiser and are not endorsing or recommending the Advertiser nor making any warranties or representations about the Advertiser's business activities or any position which is claimed to be offered. We suggest that you use common sense and exercise normal caution when making arrangements to visit or meet with Advertisers.
In case of "sponsored jobs" we will act as your recruitment partner and guide you through the entire recruitment process.

15.6 We shall not become involved in any dispute that may arise between a Candidate and an Advertiser in respect of a position including but not limited to, any dispute about the quality of work, availability of hours or pay. If, however, you have legitimate concerns or complaints about a particular Advertiser or its activities in connection with the Services and the Website, these can be directed to us.
